SCHEDULE X Purposes for which premises may not under section 353 be used without a license

 

As per Section 353 of Karnataka Municipal Corporations Act, 1976, No place within the limits of the city shall be used for any of the purposes mentioned in Schedule X without a license obtained from the Commissioner and except in accordance with the condition, specified therein. This means the trades and industries which are listed out in Schedule X of the above Act, coming under the BBMP jurisdiction have to obtain a license from BBMP Commissioner.

 

SCHEDULE X

PURPOSES FOR WHICH PREMISES MAY NOT UNDER SECTION 353 BE USED WITHOUT A LICENCE 

 

  1. Aerated waters – Manufacturing.

  2. Ammunition – Storing, packing, pressing, cleansing, preparing or manufacturing by any process whatever.

  3. Articles made of floor – Baking, preparing, keeping or storing for human consumption (for other than domestic use).

  4. Ashes – Storing, packing, pressing, cleansing, preparing or manufacturing by any process whatever, dumping or shifting

  5. Biscuits – Baking, preparing, keeping or storing for human consumption (for other than domestic use).

  6. Blood – Storing, packing, pressing, cleansing, preparing or manufacturing by any process whatever.

  7. Bones – Storing, packing, pressing, cleansing, preparing or manufacturing by any process whatever.

  8. Bread – Baking, preparing, keeping or storing for human consumption (for other than domestic use).

  9. Bricks – Manufacturing.

  10. Comphor – Storing, packing, pressing, cleansing, preparing or manufacturing by process whatever or boiling.

  11. Candles – Packing, pressing, cleansing, preparing or manufacturing by any process whatever.

  12. Carpets – Manufacturing.

  13. Catgut – Storing, packing, pressing, cleansing, preparing or manufacturing by any process whatever.

  14. Cement – Storing, packing, pressing, cleansing, preparing or manufacturing by any process whatever.

  15. Charcoal – Dumping, sifting or storing.

  16. Chemical preparations – Storing, packing, pressing, cleansing, preparing or manufacturing by any process whatever.

  17. Chillies – Grinding by machinery.

  18. Chlorate mixture – Storing, packing, pressing, cleansing, preparing or manufacturing by any process whatever.

  19. Cinders – Storing, packing, pressing, cleansing, preparing or manufacturing by any process whatever or dumping or sifting. 1977: KAR. ACT 14] Municipal Corporations 633

  20. Cloths – Dyeing.

  21. Coal – Dumping, sifting, selling or storing.

  22. Cocount fibre – Storing, packing, pressing, cleansing, preparing, or manufacturing by any process whatever.

  23. Combustible material – Storing.

  24. Combustibles – Baking, preparing, keeping or storing for human consumption (for other than domestic use).

  25. Confectionery – Baking, preparing, keeping or storing for human consumption (for other than domestic use).

  26. Cotton, cotton refuse – Storing, packing, pressing, cleansing, preparing or manufacturing by any process whatever.

  27. Dyes – Packing, pressing, cleansing, preparing or manufacturing by any process whatever.

  28. Explosive – Storing.

  29. Fat – Storing, packing, pressing, cleansing, preparing or manufacturing by any process whatever.

  30. Firewood – Selling or storing.

  31. Fireworks – Storing, packing, pressing, cleansing, preparing or manufacturing by any process whatever.

  32. Fish – Storing, packing, pressing, cleansing, preparing or manufacturing by any process whatever.

  33. Fish Oil – Storing, packing, pressing, cleansing, preparing or manufacturing by any process whatever.

  34. Flax – Storing, packing, pressing, cleansing, preparing or manufacturing by any process whatever.

  35. Fleshings – Storing, packing, pressing, cleansing, preparing or manufacturing by any process whatever.

  36. Flour – Packing, pressing, cleansing, preparing or manufacturing by any process whatever.

  37. Fuel – Using for any industrial purpose.

  38. Fulminate of mercury – Storing, packing, pressing, cleansing, preparing or manufacturing by any process whatever.

  39. Gas – Storing, packing, pressing, cleansing, preparing or manufacturing by any process whatever. 

  40. Gold – Refining.

  41. Gram – Husking by machinery.

  42. Gun cotton – Storing, packing, pressing, cleansing, preparing or manufacturing by any process whatever.

  43. Gun powder – Storing, packing, pressing, cleansing, preparing or manufacturing by any process whatever.

  44. Nitro glycerine – Storing, packing, pressing, cleansing, preparing or manufacturing by any process whatever.

  45. Nitro mixture – Storing, packing, pressing, cleansing, preparing or manufacturing by any process whatever.

  46. Offal – Storing, packing, pressing, cleansing, preparing or manufacturing by any process whatever.

  47. Oil – Storing, packing, pressing, cleansing, preparing or manufacturing by any process whatever.

  48. Paddy – Boiling or husking by machinery.

  49. Paper – Packing, pressing, cleansing, preparing or manufacturing by any process whatever.

  50. Petroleum products – Storing, packing, pressing, cleansing, preparing or manufacturing by any process whatever in quantities not exceeding six gallons, provided that no licence shall be required for storing petroleum in accordance with the provisions of the Petroleum Act, 1934 (Central Act, XXX of 1934), or the rules issued or the notifications published under that Act.

  51. Pottery – Manufacturing by any process whatever.

  52. Resin (including rosin) – Storing, packing, pressing, cleansing, preparing or manufacturing by any process whatever.

  53. Saltpetre – Storing, packing, pressing, cleansing, preparing or manufacturing by any process whatever.

  54. Seegekai – Powdering by machinery.

  55. Shellar – Storing, packing, pressing, cleansing, preparing or manufacturing by any process whatever.

  56. Soap – Manufacturing by any process whatever.

  57. Spirit – Manufacturing by any process whatever.

  58. Sulphur – Storing, packing, pressing, cleansing, preparing or manufacturing by any process whatever.

  59. Tallow – Storing, packing, pressing, cleansing, preparing or manufacturing by any process whatever. 1977: KAR. ACT 14] Municipal Corporations 635

  60. Tar – Storing, packing, pressing, cleansing, preparing or manufacturing by any process whatever.

  61. Thatching materials – Selling or storing.

  62. Tiles – Manufacturing.

  63. Timber – Selling or storing.

  64. Tobacco (including snuff, cigars, cigarattes and beedies) – Storing, pressing, cleansing, preparing or manufacturing by any process whatever.

  65. Turpentine – Storing, packing, pressing, cleansing, preparing or manufacturing by any process whatever.

  66. Wool – Storing, packing, pressing, cleansing, preparing or manufacturing by any process whatever, dyeing or drying.

  67. Yarn – Dyeing:

Provided that no licence shall be required for the storage only of any of the articles mentioned in this Schedule or for boling paddy when such storage or boiling  is for domestic use and limited to such quantities as may from time to time be fixed by the Commissioner.

  • Gilding or elctro-plating.
  • Keeping a shaving or hair-dressing saloon.
  • Keeping together pigs, or twenty or more sheep or goats or ten or more heads of cattle.
  • Manufacturing articles from which offensive or unwholesome smells, fumes, dust or noise arise.
